Send a Compliment at 0:22 PDT, 4 June, 2009If a man who worked at a Make-a-Wish event was granted a wish of his own, it would probably be that Robert Maschio from "Scrubs" didn't allegedly get drunk and choke him with his own necktie.
According to a lawsuit filed in L.A. County Superior Court, Tom Binder claims Robert -- who plays The Todd on the show -- got smashed while tending bar at a Make-A-Wish event in Santa Monica last year.
Tom -- who was working at the event -- claims Robert became so enraged when bidding on all items had come to an end, that he screamed, "You don't know who I am! I just raised $8,000 for this organization, you little piece of s**t!"
That's when the suit says Robert grabbed Tom "by his necktie and began choking him, lifting Plaintiff partly off the ground and yelling even louder: 'Let's take this outside.'"
Robert is being sued for assault and battery -- the plaintiff is seeking unspecified damages. ABC is also named as a defendant -- because the suit says Tom was a "celebrity representative" of "Scrubs."

wait wait wait .... so ABC is getting sued? why? was he working for ABC at the time? let me clarify, if things hadn't gone wrong, and assuming it was a paid appearance, would ABC have gotten a cut? .... if not then i cant really see how they're at fault. i could maybe stretch a claim that because 'the todd' was only at the event because he was a celebrity, and that scrubs is directly responsible for that .... ok, yea maybe, but still, dose anyone else think this is pushing it as far as liability claims go?
i just think suing an employer for the personal actions of an employe is ridiculous. i'll give an example: a few years back when i lived in DC, i heard on the morning radio about a local guy who was suing the city because a garbage truck accidentally backed into his car, wrecking it. simple claim, no? even makes sense on the surface. heres the kicker, HE was the driver of the garbage truck. his claim was: when he crashed the truck he did so as a city employe, so its the city's fault. obviously the case was thrown out, but it does show my point; suing ABC over a drunk actor is an almost pathetically transparent grab for a pay-out. almost expect more from a charitable organization.
I imagine the thinking was that ABC sent him there as a representative of Scrubs/ABC, not that he was just there because he was a celebrity who happens to be on one of there shows.
However, the entire lawsuit is stupid. Let the law work as it should, having him arrested, but keep it out of the court. Some people are far too quick to sue, and i agree the ABC naming, and even the naming of the actor, is more about the money they can get, than damages. If he were a regular guy, this probably wouldn't even be an issue.

Yeah, but as you say, it's a grab for money, both from the network AND the star, I think. It's overblown because he's a star.
It was an incredibly crazy thing to do, though, no doubt.
